A B.C. Supreme Court justice has endorsed a recent Federal Court
decision that the federal government's marijuana program is
unconstitutional.
Justice Marvyn Koenigsberg gave the federal government a year to fix
the medical marijuana access regulations so compassion clubs or
groups of users can get together and have a common grow operation.
At the moment, any licenced grower is restricted to supplying only
one licenced user.
And although Koenigsberg found the regulations constitutionally
wanting she still convicted Mathew Beren of Vancouver Island of
trafficking, though she gave him an absolute discharge, meaning he
will have no criminal record.
Beren had been growing pot for the local compassion club and argued
he should not be convicted because the reguations were an
unreasonable barrier to patients' access to needed medication.
The judge however said many of those served by the club lacked a
government licence to use.

IN HIS role as co-ordinator of Nova Scotia's 33 drug recognition experts, Const. Scott
MacDonald of the Halifax Regional Police sometimes takes trainees to rock concerts in
Halifax.
They don't go for the music, though.
They go - after first getting permission from the concert hall and music promoter - to
find people under the influence of drugs. "It may be a target-rich environment," he said
in a recent interview.
Const. MacDonald said that police can't be named experts until they've completed a
standard 10-day field- sobriety and drug-recognition course, scored 80 per cent or
higher on a number of exams and correctly assessed if at least eight of 12 test subjects
are either high on drugs or sober.
So the officers go to concerts and seek volunteers. They don't wear uniforms or carry
weapons. They don't ask for the names of the volunteers but do ensure they won't be
driving.
Volunteers give up about half an hour of their time to go through a 12-step procedure to
see if they are on drugs and are later asked to indicate their level of sobriety and
provide a urine sample. Details of the test are available at

On April 14, 2008, Prime Minister Stephen Harper appointed Jean-Paul Ouellette to be a
Judge of the Court of Queen's Bench of New Brunswick. In January 2009, Ouellette ruled
against Eva Marie Duplessie, sentencing her to one year in jail for growing medical
marijuana for sick people.
On December 17, 2007, Canadian Prime Minister Stephen Harper appointed Zoël R. Dionne to
be a Judge of the same New Brunswick court. In January 2009, Dionne ruled against a
couple, sentencing them to to one year of house arrest for producing child pornography.
Stephen Harper: tough on medical marijuana growers. Child pornographers, not so much.

MIRAMICHI - The woman who was caught growing what she described as a "compassionate
marijuana grow op" in her home in Bay du Vin will be going to jail in spite of telling
the court she was attempting to help people who were sick and not to make money.
Eva Marie Duplessie, 45, flew back to Miramichi from her home in Toronto to hear her
sentence on Monday, and found out she wouldn't be flying home soon.
Court of Queen's Bench Justice Jean-Paul Ouellette sentenced her to 12 months in jail
for the operation, which was uncovered in 2007.

(MOLALLA, Ore.) - I thank the Oregonian Newspaper for reports about dangerous drugs and more dangerous combinations in their story of December 24th, 2008.
The story points out that 50 million Americans are at risk. This is true because about 100 thousand patients die each year from medical misadventures which strangely enough are caused by their doctors.

for the controversial move, which would see the sale of bongs, chilum's

The council
at its Dec. 9 meeting unanimously agreed to ban medical marijuana
dispensaries in Oakley, based on problems the pot clubs have caused in
other cities. Residents with a doctor’s authorization will still be
able to possess and grow their own, however.
